Terms & Conditions
All bookings are made subject to the Ride Camps terms and conditions specified in this document.
BOOKING & PAYMENT
By booking with Ride Camps, all customers agree to be bound by these terms and conditions. It is the responsibility of each customer to read and understand the terms and conditions, and to ask questions to clarify if necessary. Once an invoice is received for your booking this must be paid in full by bank transfer to complete your booking. Bank details will be on the invoice. Once full payment is received we will send out confirmation and any necessary information about your lesson/course.
CANCELLATIONS
No refunds will be given for any Ride Camps activity cancelled by you, the client. Depending on the amount of notice given you will be provided with the following amounts of credit that can be used towards an alternative date/activity with Ride Camps.
When cancellation is given:
- 28 days or more prior to the start time of your activity, a 100% credit towards an alternative activity will be offered.
- Less than 28 days, but more than 14 days prior to the start time of your activity, a 50% credit towards an alternative activity will be offered.
- Less than 14 days prior to the start time of your activity, 0% credit will be offered.
Cancellation in writing by email must be sent to [email protected] and only valid once acknowledgment of receipt has been provided by Ride Camps.
No refund will be given by Ride Camps, in whole or in part, for unused lessons due to client late arrival, illness, accident, resort closure due to weather conditions or mechanical failure, or for any other cause outside the control of Ride Camps. We advise you take appropriate travel insurance to cover these eventualities. On request we can provide a letter for your insurance company to confirm the situation.
Ride Camps reserves the right to cancel or modify its lessons for a variety of unforeseen reasons. In the unlikely event that Ride Camps have to cancel/amend the details of your lesson you will be offered the following options:
1) Accepting the changes.
2) Cancelling your lesson, in which case we will offer you a full refund.
An exception to these conditions is in the case of group lessons as below.
If you are the only person booked onto a camp or group lesson then you will be offered a programme of private coaching which will be a reduced amount of time compared to the group lessons.
LEGAL WAIVER
RELEASE OF LIABILITY WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT. BY CLICKING OUR TERMS AND CONDITIONS YOU WILL WAIVE CERTAIN LEGAL RIGHTS. PLEASE READ CAREFULLY!
Assumptions of Risk
I am aware that mountain biking, snowboarding, skiing, and all other sports, activities and services provided by or connected with Ride Camps involve the risk of injury. I am also aware that there is a risk of negligence on the part of the Releasees, including the failure by the Releasees and their staff to safeguard or protect me from or warn me of the risks, dangers and hazards of participating in activities. I freely accept and fully assume all risks, dangers, and hazards associated with the Ride Camps activities and the possibility of loss, personal injury or death resulting therefrom.
Release of Liability, Waiver of Claims and Indemnity agreement
In consideration of my participating in Ride Camps activities, and for other valuable consideration, the receipt and sufficiency of which as acknowledged, I hereby agree as follows:
I do hereby release Ride Camps, their members, officers, directors, coaches, employees, sponsors, independent contractors and agents from all liability. I do hereby waive as against Ride Camps, their members, officers, directors, coaches, employees, sponsors, independent contractors and agents all resources, proceedings, claims and causes of action of any kind whatsoever, in respect of all personal injuries or property losses which I may suffer arising out of, or connected with my preparation for, or participation in, the event withstanding that such injuries or losses may have been caused solely or partly by the negligence of Ride Camps, or any of their members, officers, directors, coaches, employees, sponsors, independent contractors or agents.
TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all loss, damage, injury, expense or any liability for any property damage or personal injury resulting from my participation in the Ride Camps activities;
That I understand clearly that by completing my booking with payment I will be forever prevented from suing or otherwise claiming against Ride Camps, their members, officers, directors, coaches, employees, sponsors, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for the lesson/course whether or not such loss or injury is caused solely or partly by the negligence of Ride Camps or any of their members, officers, directors, coaches, employees, sponsors, independent contractors or agents;
That I understand clearly that Ride Camps would not permit me to participate in the event unless I have read and agreed to these terms and conditions this RELEASE, WAIVER AND ASSUMPTION OF RISK agreement, that this RELEASE, WAIVER AND ASSUMPTION OF RISK agreement applies to the event whether occurring in the near or distant future, and that the terms of this agreement need not be brought to my attention each time I participate in the event in order to be effective.
FORCE MAJEURE
If you are unable to attend a course due to events outside Ride Camps control we will not be liable or responsible for any failure to perform or delay in performance of any of our obligations under these terms and conditions that is caused by events outside our reasonable control ('Force Majeure Event'). A force Majeure Event includes any act, event, non-occurrence, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: strikes or other industrial actions; civil commotion, riot, invasion, terrorist attack or threat; fire, storm flood or other natural disaster, adverse weather conditions (including heavy/insufficient snow falls or non-freezing conditions), impossibility of the use of railway, shipping, aircraft, motor transport or other means of public or private transport or delays in relation to such transport; or impossibility of the use of public or private telecommunication networks. Our obligations under these terms and conditions are suspended for the period that the Force Majeure Event continues and provided that if the Force Majeure Event renders, in our opinion, the course not viable whether from a financial or logistical point of view then we may cancel or postpone the course.
MEDICAL
It is essential that you inform Ride Camps before booking any lesson with us of pre-existing medical conditions or injuries that may effect your ability to perform/participate fully in your chosen lesson. If your medical condition changes between booking & starting the lesson it is your responsibility to inform us immediately. Examples include (but are not limited to): high/low blood pressure, heart disease, stroke, diabetes, asthma, ligament problems/surgery, pregnancy, cancer, dizzyness & fainting, chest pains &/or shortness of breath during physical activity, bone & joint problems & any respiratory problems. We also need to know any medication you are currently taking, any major operations you have undergone & injuries you may be carrying. Any information you divulge will be kept strictly confidential. We are not liable for any death, personal injury or illness that occurs from your participation that is a result of a pre-existing medical condition/injury/illness that you did not make us aware of.
PARENTAL CONSENT
The person booking must ensure that all participants under 18 years of age have been given consent by their parents/guardians to take part in Ride Camps lessons or courses.
INSURANCE
It is a condition of booking that all guests have adequate insurance. This should cover such events as personal injury, illness, accident risk, medical expenses and rescue & evacuation including helicopter rescue, however this list is not exhaustive and it is your responsibility to ensure that your insurance covers the activities you will be participating in. We strongly recommend that you also take out insurance to cover baggage and personal items loss and damage, and to cover the costs should you need to cancel the trip. On booking, you will be asked to provide your insurance provider and policy. This must be submitted prior to joining the trip. If you cannot provide your leader with your insurance details, you will be refused permission to take part in the trip, and no refund will be given.
FITNESS, HEALTH & SAFETY
It is your responsibility when booking to ensure that you and members of your group are fit enough to cope with the activity and the environment associated with your booking. Clients must inform us prior to the event of any medical condition, illness, disability (including medication which may affect their performance) so we can discuss your needs and make appropriate arrangements. All clients should inform their instructor immediately if they feel unwell during the activity. Clients must adhere to the instructions, guidance and decisions of our instructors as they have specialist knowledge & skills and are committed to keeping you safe. Alcohol or illicit drug use is not permitted prior or during activities. Clients must show respect to equipment / vehicles / buildings / other clients / neighbours / staff / accommodation rules – Abuse or causing distress to others or loss/damage due to negligence will result in repair / full replacement costs. This may also lead to exclusion from activities / accommodation / courses without refund.
EQUIPMENT
It is your responsibility that you have the correct equipment to come on the lesson/course. A guideline will be sent out with your lesson/course confirmation pack. Equipment is not included in the price of your course or lesson.
LIFT PASSES
Lift Passes are not included in the price of your lesson/course. If you are doing an activity that requires a lift pass then please organise this in advance of your lesson/course.
PHOTOGRAPHS, MARKETING & SOCIAL MEDIA
Photographs and videos may be taken by Ride Camps during your activity for marketing purposes. A selection of these may be uploaded to our website, social media sites or for other marketing purposes and publications.
